Minister Forto welcomed OFAC measures and requested the Consortium to make a statement

BiH Minister of Communications and Transport, Edin Forto, welcomed the actions undertaken by the Office of Foreign Assets Control (OFAC) aimed at preventing activities violating or posing a threat to the implementation of the Dayton Peace Accord, and in particular those aimed at preventing corruptive actions.

The company Sirius 2010 – leader of the Consortium designated on the basis of an international tender to implement the second phase of the radio and television signal digitalisation worth 25.8 million (excluding VAT), was also among seven companies in total from BiH which were added yesterday to the OFAC sanction list.

Given the new circumstances, the Minister Forto has requested the Commission in charge of monitoring the digitalization project implementation to provide the statement made by the Consortium regarding the Consortium ability to implement, in line with the signed Contract, general and specific conditions from tender documents, and to make a comprehensive report on the project implementation. The Council of Ministers will be informed about details of this Report together with the opinions obtained from the relevant institutions.

The contract with the Consortium consisting of the Sirius 2010 from Banja Luka and the Odašiljači i veze from Zagreb was signed in January this year on the basis of the Tender which was announced in mid-2022 during the mandate of the previous Council of Ministers, and to which only two bids were received.

In July last year, at the proposal of the Commission for implementing public procurement for digital transmission and broadcasting, the Decision on a sole qualified bidder – which was the Consortium led by Sirius 2010, was adopted.

Following the adoption of final acts by the BiH Procurement Review Body and the Court of Bosnia and Herzegovina, and upon obtaining positive opinion from the Prosecutor's Office of BiH, the Contract has been signed with the Consortium led by Sirius 2010.

The previous attempt to implement the public procurement procedure with regard to the radio and television signal digitalisation failed in 2017 when no qualified bids were received in response to the public call for tenders.

As a signatory of the Geneva Agreement, Bosnia and Herzegovina has undertaken an obligation to shut down analogue tv signal by June 2015, and is now a sole country in Europe that has failed to complete the process of radio and television signal digitalisation.
